Terms of Service

These Terms govern your use of Clckd, provided by Over-Biz. By subscribing to or using the service, your organization agrees to these Terms. Specific commercial terms (pricing, tier, and term length) are set out in your quotation or order.
The service
Clckd is a cloud-hosted biometric time & attendance system with an on-site fingerprint clock-in kiosk (which operates offline and syncs when connectivity returns), leave management, shift scheduling, timesheets with CSV export, and a web admin portal.
Subscription, hardware, and setup
- The subscription is billed in advance (annually or quarterly, per your order) and covers the tier stated in your quotation. The Pro tier covers 35–50 active employees with one clock kiosk; beyond 50 employees, Enterprise pricing applies.
- The hardware package and onboarding & on-site setup are one-time charges. Hardware carries the manufacturer’s warranty; the kiosk runs on your internet/Wi-Fi.
- Prices are in Philippine Pesos and exclusive of applicable taxes.
What's included
The subscription includes cloud hosting, bug fixes, and minor improvements to existing features at no extra cost during the term. Major new modules (for example, facial recognition) are not included; they are quoted separately as add-ons or unlocked via a plan upgrade.
Support
Standard issues are addressed within 1–3 business days. Urgent / P1 issues (for example, a kiosk that cannot clock in) are prioritized within the same business day.
Your responsibilities
You are responsible for obtaining employee consent for biometric enrollment, providing an alternative attendance method where an employee declines, keeping administrator credentials secure, and using the service in compliance with applicable law.
Data protection
We process personal and biometric data as described in our Privacy Policy and in accordance with the Philippine Data Privacy Act (RA 10173).
Warranties and liability
The service is provided on a commercially reasonable basis. To the extent permitted by law, Over-Biz is not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law.
Term and termination
The subscription runs for the term stated in your order and renews as agreed. Either party may terminate for material breach that is not remedied within a reasonable period. On termination, data is deleted or returned per our agreement.
Governing law
These Terms are governed by the laws of the Republic of the Philippines.
